Miami kidnapping defense attorney Michael Mirer can help if you have been accused of kidnapping or false imprisonment. He offers a free initial consultation to discuss your case and how he can help you, and he may be able to get started immediately in protecting your rights and interests.

Florida Kidnapping Charges

Florida Code, Section 787.01 defines kidnapping as, "…forcibly, secretly, or by threat confining, abducting, or imprisoning another person against his or her will and without lawful authority…" with the intent to hold for ransom, use as a shield or hostage, commit a felony offense, physically injure the victim, or interfere with any governmental function. Kidnapping as defined in this section or involving the confinement of a child under the age of 13 is a first degree felony offense and may be punishable by up to life in prison, or by up to 30 years in state prison and/or a fine of up to $10,000.

Lesser forms of kidnapping are referred to as "false imprisonment" and include holding a person against their will but not for the purpose of collecting ransom, of causing injury or of committing a felony offense. False imprisonment in this sense is a third degree felony, punishable by up to 5 years in prison and a fine of up to $5,000.

Kidnapping may also be charged as a federal crime if the defendant is accused of taking the victim across state lines.
